Terms of Service

1. Subject of the contract

Registriert.ch is a service of WebMix Schindelholz (hereinafter WebMix). We offer customers automated monitoring of Swiss Internet addresses (.ch) that are scheduled for deletion. The aim is the automated registration of the address at the moment it is officially released by the registry.

2. Costs & success fee

Our service is consistently based on the success principle. Charges only apply in the event of a successful reservation:

• Monitoring service: CHF 59.00
• Annual fee for the Internet address: CHF 14.90

If the Internet address could not be obtained by our system for the customer, neither the service fee nor the annual address fee will be charged. The monitoring service of CHF 59.00 is the starting price; if several customers are interested in the same address, the highest bid from the auction under section 3 applies instead.

3. Auction if several parties are interested

If several customers reserve the same address, an auction decides. It runs until 23:55 on the day of release. The first reservation counts as the first bid at the starting price.

• Starting price: CHF 59.00. Minimum increment: CHF 5.00.
• Binding nature: every bid is binding and cannot be withdrawn.
• Extension: a bid placed shortly before the end extends the auction by a few minutes, so that all interested parties can react.
• Price upon award: the highest bid replaces the starting price, plus the annual fee for the address. Here too, charges only apply if the registration succeeds.

4. Release date and corrections

The expected release date of an address comes from the registry's data. It may change or later turn out to be inaccurate and is not a warranted characteristic of our service.

If the date changes, the reservation and the auction are automatically moved to the new date; bids already placed remain valid. WebMix informs the customers concerned by e-mail. Anyone who no longer wants the address may withdraw their reservation free of charge up to 24 hours before the auction ends – a short message is sufficient.

If an address is renewed by its current holder and therefore not released, the order lapses at no cost to the customer.

5. Disclaimer

WebMix uses high-performance systems but expressly cannot accept any liability for the success of the registration. A contract for the acquisition of the address only comes into effect upon successful confirmation by the registry.

WebMix accepts no liability for direct or indirect damages arising from the inability to register an Internet address — whether due to technical disruptions, delays at the registry or because a third-party system completed the registration process faster.

6. Payment conditions & advance payment

After successful registration of the address, the customer receives an invoice by e-mail. The following conditions apply:

• Payment term: 10 days after receipt of the invoice.
• Default: if the deadline is exceeded, the customer is in default. From the first reminder onwards, default interest of 5% per annum is due. WebMix is entitled to charge the customer reminder fees as well as any costs of debt collection and enforcement.
• Right to advance payment: WebMix expressly reserves the right to make execution of an order conditional on advance payment (prepaid account), in particular for new customers or larger order volumes.
• Binding nature & cancellation: acceptance of the offer concludes a binding purchase contract. The customer has no right of cancellation or withdrawal.
• Cancellation fee: if WebMix rescinds the contract due to non-payment or other non-performance by the customer, or if an amicable cancellation is exceptionally agreed, WebMix is entitled to demand, instead of performance, a cancellation fee (liquidated damages) of 20% of the agreed purchase price, but at least CHF 150. The right to claim higher actual damages and to insist on performance is expressly reserved.

7. API interface

The use of the registriert.ch application programming interface (API) is additionally subject to the following provisions. Plans, quotas and prices are those shown on registriert.ch/api at the time of ordering.

• API key: the key is personal and may not be passed on to third parties. The customer is responsible for all use of their key. If a key is lost or misused, WebMix will disable it on request and issue a new one.
• Quota: each plan includes a certain number of requests per day. The quota resets at midnight (Swiss time); unused requests expire.
• Term and payment: the Pro and Business plans are paid in advance for one month or one year (prepayment). The term starts on the day of the order; the key is activated once payment is received. Before expiry, the customer receives the invoice for the following period.
• End of the plan: if the invoice for the following period is not paid by the expiry date, the plan ends automatically and the key continues to work within the free limits of the Starter plan. Cancellation is therefore possible at any time as of the end of the paid term. Terms already paid are not refunded.
• Permitted use: the data may be used in your own applications and services. Prohibited are reselling or passing on the data as your own list or database, systematically scraping the marketplace and circumventing the quotas, for example with several keys or IP addresses.
• Availability and data: WebMix strives for uninterrupted operation but does not guarantee any particular availability. The results are based on live queries to registries and on data from public sources; they may be delayed or inaccurate. The exclusion of liability under section 5 applies.
• Suspension and changes: in the event of a breach of these provisions, WebMix may suspend access without refund. WebMix may develop the interface technically; significant changes will be communicated in advance by email to customers holding a key.

8. Trademark rights

The customer bears sole responsibility for ensuring that the requested address does not infringe any trademark, naming or copyright rights of third parties. WebMix does not carry out any legal review.

9. Place of jurisdiction

The place of jurisdiction is Lucerne, Switzerland. Swiss law applies exclusively.

10. Changes to the Terms and prices

WebMix is entitled to update or adapt these Terms as well as the pricing structure at any time. For orders already placed, the Terms and prices in force on the website at the time the order was submitted shall apply.

11. Partial invalidity

Should individual provisions of these Terms be or become wholly or partly invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

In place of the invalid or unenforceable provision, the legally permissible rule that comes closest to the economic purpose of the replaced provision shall apply. The same applies to any gaps in these Terms.

12. Authoritative version

These Terms are published in several languages. In the event of any divergence in interpretation between the language versions, only the German version shall be legally binding.
